I’m a 24 yr old who is diagnosed with Bipolar and Borderline Personality disorder with a 2 month old son. My dad recently passed away 9 days after my son was born. I’m having family problems at home with my mom,  to the point where she wants to kick me and my son’s father out of the house. My son’s father has health issues which involves seizures and my mom is also diagnosed with Bipolar. She is also threatening to call child services on me if I take my son to live with us at our apt. She is not on medication at the moment. Now, if she hires a lawyer like she says she’s going to do, what are my chances of who’s going to get custody of my son?

I’m really sorry about the loss of your father. That must be really difficult.

As for your son, most of the time, they try to put the child with their biological parents. Only if that environment is unsafe or unstable will they take the child away. As long as you take care of yourself and take your meds as prescribed, and go to your Pdoc when necessary, you shouldn’t have any problems. Also, your husband needs to get medical attention too. If CYS sees that you are both doing your best to take care of yourselves and your son that will go in your favor.

Another thing in your favor is the fact that your mother is also bipolar, but is not on medication. This is definitely trouble for her. Both for her sake, and for her chances of getting custody of your son. She may be deemed unfit to take care of a child. Especially if she is unstable.

So, chances are you will be able to keep custody of your son. I really hope you do get to keep him.
